1. Introduction

Billionaires Font Ltd. respects the intellectual property rights of font creators, type foundries, and all rights holders. We operate billionairesfont.com as a font hosting and distribution intermediary - fonts available on our platform are submitted by independent third-party users and foundries. We do not create, own, or independently verify the licensing or ownership of submitted fonts.

In accordance with the United States Digital Millennium Copyright Act (DMCA) and in the spirit of international copyright law, we respond promptly to valid notices of alleged copyright infringement. Where a notice meets the requirements set out in this policy, we will act swiftly to remove or disable access to the reported content.

We also maintain a strict repeat infringer policy: accounts responsible for repeated, verified infringement will be suspended or permanently terminated from our platform.

If you are a copyright holder - or an agent authorized to act on behalf of a rights holder - and you believe that a font hosted on billionairesfont.com infringes your copyright, you may submit a takedown notice to us.

2.1 What Your Notice Must Include To be considered valid under the DMCA, your notice must contain all of the following:

  • Identification of the copyrighted work - A clear description of the original work you claim has been infringed (e.g., the name of the font family, the foundry that created it, and any registration or copyright information you hold).
  • Identification of the infringing material - The name of the font on our platform and a direct URL or link to the specific page where it appears (e.g., `https://billionairesfont.com/font/[font-name]`).
  • Your contact information - Your full legal name, email address, mailing address, and phone number. If you are acting as an authorized agent on behalf of the rights holder, please state this clearly and provide the rights holder's name as well.
  • Good faith statement - A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement - A statement that the information in your notice is accurate.
  • Perjury statement - A statement, made under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • Signature - Your physical or electronic signature.

Notices that are incomplete, vague, or do not meet the requirements above may not be actioned. We strongly recommend reviewing the full DMCA requirements at the U.S. Copyright Office before submitting.

3. What Happens After a Notice is Received

Once we receive a takedown notice, we will:

  • Review the notice to assess whether it meets the requirements set out in Section 2
  • Remove or disable access to the reported font promptly if the notice is valid - typically within a seven (7) business days
  • Notify the submitter who uploaded the font that it has been removed and the reason for removal
  • Record the action as part of our repeat infringer tracking process

We will not adjudicate disputes between rights holders and submitters. If the underlying dispute is contested, parties may need to resolve the matter through appropriate legal channels.

4. Counter-Notice Process

If you are a font submitter and you believe your font was removed in error - for example, because the takedown notice was based on a misidentification or a misunderstanding of the applicable license - you may submit a counter-notice.

4.1 What Your Counter-Notice Must Include

  • Identification of the removed font - The name of the font that was removed and the URL where it previously appeared on our platform.
  • Statement of good faith and error - A statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification.
  • Your contact information - Your full legal name, email address, mailing address, and phone number.
  • Consent to jurisdiction - A statement that you consent to the jurisdiction of an appropriate court for the purpose of any legal proceedings related to the takedown, and that you will accept service of process from the person who submitted the original notice.
  • Signature - Your physical or electronic signature.

4.2 Where to Send Your Counter-Notice

Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the removed font after the waiting period required under the DMCA, unless the complainant notifies us that they have initiated legal action. We are not obligated to restore content and make this determination at our sole discretion.

5. Repeat Infringer Policy

We track all valid infringement notices and the accounts associated with reported content. In accordance with the DMCA and our own platform policies:

  • Accounts that accumulate multiple verified, valid infringement claims will be suspended
  • Accounts that continue to infringe following a suspension, or that are responsible for egregious or deliberate infringement, will be permanently terminated
  • Terminated accounts may not re-register on the platform

This policy applies regardless of whether the infringing uploads were accidental or intentional.

6. False or Misleading Notices

Submitting a DMCA takedown notice that you know to be false or materially misleading is a serious matter. Under 17 U.S.C. § 512(f) of the DMCA, any person who knowingly and materially misrepresents that content is infringing may be liable for damages - including costs and legal fees - incurred by the affected party.

We reserve the right to pursue all available legal remedies against individuals or entities who abuse the takedown process, including those who submit notices in bad faith to suppress lawfully uploaded content.

While the formal takedown process described in this policy is modelled on the US DMCA, we take intellectual property complaints from rights holders in all jurisdictions seriously.

If you are based outside the United States and believe that content on our platform infringes your copyright under the laws of your country, you are welcome to use the same process described in Section 2. Please include a brief description of the legal basis for your claim under your applicable national law (e.g., the EU Copyright Directive, the UK Copyright, Designs and Patents Act 1988, or equivalent).

We will review all international complaints and take appropriate action where infringement is evident, even where the formal DMCA mechanism does not strictly apply.

8. Font Submitter Responsibility

By submitting a font to billionairesfont.com, you represent and warrant that:

  • You are the original creator of the font, or hold a license that explicitly permits you to distribute it to third parties
  • Your submission does not infringe the intellectual property rights of any third party
  • Any metadata, descriptions, or licensing information you provide alongside the submission is accurate and not misleading

You agree to indemnify, defend, and hold harmless Billionaires Font Ltd. and its affiliates from and against any claims, damages, losses, liabilities, costs, or legal fees arising out of or related to your submission - including any claims by third parties that your submission infringes their intellectual property rights.

9. Safe Harbor

Billionaires Font Ltd. operates as a hosting intermediary under the safe harbor provisions of the DMCA (17 U.S.C. § 512(c)) and, where applicable, equivalent provisions under international law. This safe harbor protection is conditional on our continued compliance with the notice-and-takedown process described in this policy, including our repeat infringer policy.

We do not pre-screen or curate submitted fonts for copyright compliance before publication. Rights holders are responsible for monitoring our platform for infringing uses and reporting them to us via the process above.
