1. Introduction & Acceptance

Welcome to billionairesfont.com, operated by Billionaires Font Ltd. ("we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of our website, platform, font conversion tools, and all associated services (collectively, the "Platform"). By accessing or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and all policies incorporated by reference, including our Privacy Policy, Cookie Policy, Font License Policy, and DMCA & Copyright Policy.

If you do not agree to these Terms, you must not access or use the Platform.

We may update these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Platform after any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Who We Are

Billionaires Font Ltd. operates billionairesfont.com as a font hosting and distribution intermediary. Our Platform allows independent type designers, foundries, and font enthusiasts to submit, share, and distribute typefaces, and allows users to browse, preview, download, and convert those fonts.

We do not create, commission, own, curate, or endorse any of the fonts made available on the Platform. All fonts are submitted by independent third parties, and we act solely as a hosting intermediary. We are not responsible for the content, quality, accuracy, or legal status of submitted fonts.

3. Eligibility

3.1 Minimum Age to Use the Platform You must be at least 13 years old to access or use the Platform. This requirement reflects our compliance with the Children's Online Privacy Protection Act (COPPA). By using the Platform, you represent and warrant that you meet this minimum age requirement. If you are under 13, you must not use the Platform in any way.

3.2 Font Submissions To submit fonts to the Platform, you must be at least 18 years old, or at least the age of legal majority in your jurisdiction - whichever is greater - or have the verifiable consent of a parent or legal guardian.

3.3 Organizational Use If you are accessing or using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and that the organization agrees to be bound by them.

4. User Accounts

4.1 Account Registration An account is required to submit fonts to the Platform. You may browse, preview, download, and use the font conversion tools without an account, subject to any limitations we may apply from time to time.

4.2 Account Security You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@billionairesfont.com if you become aware of any unauthorized access to or use of your account.

4.3 Accurate Information You agree to provide accurate, current, and complete information when registering for an account and to keep that information up to date.

4.4 Account Termination by Us We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for any reason - including violation of these Terms, submission of infringing content, or prolonged inactivity. See Section 13 for full details on termination.

5. Font Submissions

5.1 Submitter Representations and Warranties By submitting a font to the Platform, you represent and warrant that:

  • You are the original creator of the font, or you hold a valid license that explicitly permits you to distribute the font to third parties
  • Your submission does not infringe the copyright, trademark, trade secret, or any other intellectual property rights of any third party. For reference, copyright protection is explained by the U.S. Copyright Office and, internationally, by the World Intellectual Property Organization (WIPO)
  • Any metadata, descriptions, or licensing information you provide alongside your submission is accurate, complete, and not misleading
  • Your submission does not violate any applicable law or these Terms

5.2 License Grant to Billionaires Font Ltd. By submitting a font, you grant Billionaires Font Ltd. a non-exclusive, royalty-free, worldwide, sublicensable license to host, store, display, reproduce, distribute, and make available your submitted font and its associated metadata on the Platform for as long as it remains published. This license does not transfer ownership of the font to us. You retain all intellectual property rights in your submission.

5.3 Removal of Submissions We reserve the right to remove any submitted font from the Platform at any time and for any reason, including receipt of a valid copyright takedown notice, violation of these Terms, or our reasonable determination that the submission poses a legal or reputational risk. We are under no obligation to provide advance notice before removal.

5.4 Intellectual Property Liability All IP liability arising from a font submission rests solely with the submitter. Billionaires Font Ltd. will not be held liable for any infringement resulting from a font submitted by a third party. See Section 12 (Indemnification) and Section 9 (Intermediary Safe Harbor) for further detail.

6. Font Downloads & Licensing

6.1 Individual Font Licenses Every font available on the Platform carries its own license, set by the submitter at the time of upload. License types may include - but are not limited to - personal use only, commercial use, the SIL Open Font License (OFL), Creative Commons licenses, or proprietary licenses with specific conditions.

6.2 Your Responsibility to Review Licenses Before downloading or using any font, you are solely responsible for reading and understanding the license associated with that font. Downloading a font does not grant you any rights beyond what that font's specific license permits. Billionaires Font Ltd. is not a party to any license between you and the font's creator or rights holder.

6.3 No Guarantee of Licensing Accuracy Billionaires Font Ltd. makes no representations or warranties about the accuracy, completeness, or enforceability of any font license displayed on the Platform. License information is provided by the submitter and is reproduced on our Platform as-is.

6.4 Font Conversion Tools Our Platform includes tools that allow you to convert font files between formats (e.g., TTF to WOFF2). By using these tools, you acknowledge that:

  • You are solely responsible for ensuring you have the legal right to convert the font under its applicable license
  • Converting a font does not alter, expand, or transfer any licensing rights that apply to that font
  • Converted files are provided as-is with no guarantee of quality, compatibility, or fitness for purpose
  • Uploaded files are processed temporarily and deleted automatically after conversion - see our Privacy Policy for details

7. Prohibited Conduct

You agree not to use the Platform in any of the following ways:

  • Submitting infringing content - Do not submit any font that you do not own or are not fully licensed to distribute
  • Misrepresenting licensing - Do not submit a font with inaccurate, misleading, or falsified license information
  • Unauthorized conversion - Do not use the font conversion tools to convert fonts whose licenses prohibit conversion or format modification
  • Bulk scraping or automated downloading - Do not scrape, crawl, systematically download, or use automated tools to extract fonts or content from the Platform in bulk without our prior written consent
  • Platform tampering - Do not attempt to reverse-engineer, decompile, interfere with, or gain unauthorized access to any part of the Platform or its underlying systems. Unauthorized access to computer systems may constitute a criminal offence under the Computer Fraud and Abuse Act (CFAA) and equivalent laws in other jurisdictions
  • Circumventing restrictions - Do not attempt to bypass, disable, or circumvent any access controls, licensing restrictions, or security measures on the Platform
  • Unlawful use - Do not use the Platform for any purpose that is unlawful, harmful, or in violation of any applicable law or regulation
  • Harassment or abuse - Do not use the Platform to harass, threaten, or harm any individual or entity

We reserve the right to investigate suspected violations and to take any action we deem appropriate, including removing content, suspending accounts, and reporting conduct to law enforcement.

8. Intellectual Property

8.1 Platform Ownership Billionaires Font Ltd. owns all rights in and to the Platform itself - including its design, user interface, codebase, branding, original editorial content, and the "Billionaires Font" name and logo. Nothing in these Terms transfers any of these rights to you.

8.2 Font Files Font files available on the Platform remain the property of their respective creators, foundries, or rights holders. Billionaires Font Ltd. claims no ownership over any submitted font.

8.3 User-Submitted Content You retain ownership of any fonts, descriptions, or other content you submit to the Platform, subject to the license grant in Section 5.2.

8.4 Feedback If you submit suggestions, feedback, or ideas about the Platform, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

9. Intermediary Safe Harbor

Billionaires Font Ltd. operates as a hosting intermediary. We store and make available font files and associated content submitted by third-party users, but we do not pre-screen, curate, or independently verify submissions for copyright compliance, licensing accuracy, or any other legal consideration before publication.

We are not liable for the accuracy, legality, quality, intellectual property status, or fitness for purpose of any font submitted by a third party and hosted on our Platform.

We will act promptly on valid copyright takedown notices submitted in accordance with our DMCA & Copyright Policy. This policy, and our compliance with it, forms the basis of our safe harbor protection under 17 U.S.C. § 512(c) and equivalent provisions under applicable international law.

10. Disclaimers & No Warranty

THE PLATFORM AND ALL FONTS, TOOLS, AND CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, Billionaires Font Ltd. expressly disclaims all warranties, including but not limited to:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
  • Any warranty that the Platform will be uninterrupted, error-free, secure, or free of viruses or harmful components
  • Any warranty as to the quality, compatibility, accuracy, or completeness of any font file, conversion output, or other content on the Platform
  • Any warranty that a font's stated license is accurate, enforceable, or sufficient for your intended use

Your use of the Platform and any fonts or tools available through it is entirely at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Billionaires Font Ltd., its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages - including but not limited to loss of profits, loss of data, loss of goodwill, or the cost of substitute services - arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the Platform exceed the greater of:

  • The total amount you have paid to Billionaires Font Ltd. (if any) in the twelve (12) months immediately preceding the event giving rise to the claim, or
  • USD $50.00

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. Where such limitations are prohibited by applicable law, our liability will be limited to the fullest extent permitted.

12. Indemnification

You agree to indemnify, defend, and hold harmless Billionaires Font Ltd. and its affiliates, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your access to or use of the Platform
  • Any font, content, or material you submit to the Platform
  • Your violation of these Terms
  • Your violation of any third party's rights, including intellectual property rights
  • Any claim that a font you submitted infringes the rights of a third party

This indemnification obligation survives any termination of these Terms or your account.

13. Termination

13.1 Termination by You You may stop using the Platform at any time. If you have an account, you may request deletion of your account by contacting us at legal@billionairesfont.com. Upon account deletion, your submitted fonts may remain on the Platform unless you separately request their removal.

13.2 Termination by Us We reserve the right to suspend or permanently terminate your access to the Platform at any time, with or without cause and with or without notice, including for:

  • Violation of these Terms or any of our policies
  • Submission of infringing or unauthorized content
  • Repeated valid copyright infringement claims against your account
  • Conduct we determine to be harmful to the Platform, other users, or third parties

13.3 Effect of Termination Upon termination, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination - including Sections 5.4, 8, 9, 10, 11, 12, and 14 - shall continue to apply.

14. Dispute Resolution

14.1 Informal Resolution We encourage you to contact us at legal@billionairesfont.com before initiating any formal dispute. Many concerns can be resolved quickly and informally.

14.2 Binding Arbitration If a dispute cannot be resolved informally, you and Billionaires Font Ltd. agree that it shall be resolved exclusively by binding individual arbitration. The arbitration shall be conducted under widely recognized commercial arbitration rules and procedures, such as the UNCITRAL Arbitration Rules or equivalent. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Class Action Waiver You agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to bring or participate in any class action, collective action, or representative action against Billionaires Font Ltd. This waiver applies to all claims, whether resolved through arbitration or otherwise.

14.4 Exceptions Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

15. Governing Law

These Terms are governed by and construed in accordance with the applicable laws of the jurisdiction in which Billionaires Font Ltd. operates, without regard to conflict of law principles. Where mandatory consumer protection laws of your home jurisdiction provide you with greater rights than those set out in these Terms, those rights are not excluded by this clause. EU and UK users may also benefit from rights under the General Data Protection Regulation (GDPR) and the EU Consumer Rights Directive, which apply independently of these Terms.

16. Changes to These Terms

We may update these Terms at any time to reflect changes in the law, our platform, or our business practices. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we may also display a notice on the Platform or send a notification to registered users.

Your continued use of the Platform after any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.

17. Miscellaneous

17.1 Entire Agreement These Terms, together with our Privacy Policy, Cookie Policy, Font License Policy, and DMCA & Copyright Policy, constitute the entire agreement between you and Billionaires Font Ltd. regarding your use of the Platform.

17.2 Severability If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or arbitrator, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17.3 No Waiver Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.

17.5 Language These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
